Divorce can be terrifying and hard, and unfortunately, it may not always get easier as you go through the process. A key component to having an easier divorce process is getting support from many different people including legal or emotional support. Another important component of having an easier divorce is familiarizing yourself with all aspects that will be brought up in the process (finances, assets, children, etc.)  An even easier divorce process is when neither party contests the petition for a dissolution of marriage.

This form comes with a set of instructions that explains when to use this form and how to fill it out.

Answer And Waiver

If you have been served with a petition for petition of marriage and you do not wish to contest it or appear at a hearing, this form should be used. When you fill out and file this form, you are admitting all of the allegations in the petition, and that you do not need to be notified or appear at the final hearing. This form also says that you would like a copy of the final judgment mailed to you.  If you contest this petition and do not agree with anything, you need to fill out a different answer form.

If you receive a divorce petition, you must file a written answer within 20 days. A copy of this form with answer and wavier must be delivered to your spouse.  With this form you must also fill out other forms (if they are applicable to your case), including:

  • Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA) Affidavit
  • Child Support Guidelines Worksheet
  • Marital Settlement Agreement for Dissolution of Marriage with Dependent or Minor Child(ren), or Marital Settlement Agreement for Dissolution of Marriage with No Dependent or Minor Child(ren)
  • Notice of Social Security Number
  • Family Law Financial Affidavit
